Waiver, Release, and Assumption of Risk Agreement

IMPORTANT: PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

This is a binding legal agreement; therefore clarify any questions or concerns before signing. As a Participant in the recreational and/or sporting activities organized, operated, conducted, and/or sanctioned by the Grimpeurs Cycling Club (GCC), the undersigned acknowledges and agrees to the following terms:

Acknowledgment of Risks

I, the undersigned, hereby acknowledge that participation in cycling and other recreational or sporting activities organized by GCC involves inherent risks including, but not limited to, the risk of serious injury or death. I understand that these risks may result from various factors including, but not limited to, traffic conditions, road and trail conditions, weather conditions, equipment failure, or the negligence of other participants.

Assumption of Risks

I am participating voluntarily in the sport of cycling and in the recreational, social, training, and competitive activities, events, and programs of GCC. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers, and hazards associated with or related to these activities, including, but not limited to:

Road cycling, gravel cycling, and mountain biking.

Organized and informal group rides, time trials, ultrafondos, training camps, recreational rides, and social events.

Executing strenuous and demanding physical techniques.

Vigorous physical exertion, rapid movements, quick turns, and stops.

Mounting, dismounting, or falling off a bicycle.

Physical contact with other participants.

Slips, trips, and falls on course or at any event accommodations.

Mechanical failure of equipment or inadequate safety equipment.

Contact or collisions with other participants, pedestrians, fixed objects, spectators, equipment, or vehicles.

Road conditions, terrains, and vehicular traffic.

Extreme weather conditions causing dehydration, heatstroke, sunstroke, or hypothermia.

Spinal cord injuries which may result in permanent paralysis or death.

Travel to and from events or activities.

Use of rented or borrowed bicycles.

I understand that injuries sustained can be severe and that my risk of injury is reduced if I follow all rules established for participation. My risk of injury increases as I become fatigued.

Release and Waiver

In consideration of being permitted to participate in any GCC activities, I hereby release, waive, and discharge Grimpeurs Cycling Club, its officers, members, volunteers, sponsors, and any other entities or individuals associated with the activities (collectively, the “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of the Released Parties or otherwise.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of or in any way related to my participation in GCC activities, including the actions of other participants or third parties.

Traffic and Road Use Conditions

I understand that many GCC activities are conducted on public roads open to regular traffic, without road closures or exclusive use for participants. I agree to obey all traffic laws and regulations at all times during participation.

Medical Treatment

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in any GCC activity. I agree to be solely responsible for all costs related to such medical treatment, medical transportation, and any related expenses.

Personal Property

I acknowledge that I am solely responsible for my personal belongings during any GCC activity. The Released Parties are not responsible for any loss or damage to my personal property.

Photography and Media

I grant the Released Parties the right to use, reproduce, and distribute any photographs, videos, or other media taken of me during GCC activities for any legitimate purpose, including promotional materials and publicity. I release the Released Parties from any liability related to such use.

Helmet and Safety Equipment

I acknowledge that wearing a helmet is mandatory at all times while participating in cycling activities for my safety. Failure to wear a helmet may result in exclusion from the activity. Wearing lights for visibility is recommended, and earbuds or headphones are prohibited by law.

Health and Insurance

I acknowledge that I have obtained health and travel insurance and am responsible for any costs of medical treatment. The Released Parties are not liable for personal injury, death, or damages resulting from participation in GCC activities.

Severability

I expressly agree that this Waiver, Release, and Assumption of Risk Agreement is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario, and that if any portion hereof is held invalid, the remainder shall continue in full legal force and effect.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario. Any litigation involving the parties to this Agreement shall be brought within the exclusive jurisdiction of the Courts of the Province of Ontario.

Acknowledgment of Understanding

I have read this Waiver, Release, and Assumption of Risk Agreement and fully understand its terms. I acknowledge that I am signing this Agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

CONFIRMATION OF AGREEMENT

I confirm that I have read and understood this Agreement prior to signing it. I am aware that by signing this Agreement, I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns, and representatives may have against the Released Parties.
